Penetration testing is explicitly required at CMMC Level 3, which incorporates the enhanced controls of NIST SP 800-172. NIST SP 800-172 requirement 03.11.03e (Penetration Testing, referenced in the CMMC Level 3 Assessment Guide v2.13, Sep 2024, under the Security Assessment domain) mandates: "Employ [automated tools and/or manual techniques] to conduct penetration testing at least annually and when significant changes are made to the system," leveraging automated scanning plus ad hoc tests by subject-matter experts. Who must comply: DoD contractors and subcontractors (Defense Industrial Base) that store, process, or transmit Federal Contract Information (FCI) or Controlled Unclassified Information (CUI) on their systems; excludes COTS-only contracts. Level determined by data sensitivity: L1 (FCI), L2 (CUI, ~80k+ orgs), L3 (highest-priority CUI / APT-targeted programs, small subset). Requirements flow down from primes to lower-tier subs.
